FARM SCHOOL PROGRAM

PARENT / LEGAL GUARDIAN LIABILITY WAIVER AND RELEASE

 

WASHINGTON STATE REQUIRED AGRITOURISM WARNING NOTICE (RCW 4.24.835)

WARNING: Under Washington state law, there is limited liability for an injury to or death of a participant in an agritourism activity conducted at this agritourism location if such an injury or death results exclusively from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals; as well as the potential for you to act in a negligent manner that may contribute to your injury or death. We are required to ensure that in any activity involving minor children, only age-appropriate access to activities, equipment, and animals is permitted.

 

WAIVER AND RELEASE FROM LIABILITY

I am the legal parent or guardian of the student enrolled in the Feral Woman Farm LLC Farm School program ("Student"). I hereby WAIVE AND RELEASE, indemnify, hold harmless, and forever discharge Lulu Redder, Feral Woman Farm LLC (DBA Plucky Palomino), and Feisty Fowl LLC, and their respective agents, employees, officers, directors, affiliates, successors, and assigns (collectively, "the Farm"), of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I or my Student ever had or may have, arising from or in any way related to the Student’s participation in the Farm School program or any related Farm activities, whether on-site or off. This waiver does not apply to acts of gross negligence or intentional, willful, or wanton misconduct by the Farm.

Shared and Leased Premises

I understand and acknowledge that Feral Woman Farm LLC operates within a leased, shared-use agricultural property. The premises may be simultaneously or sequentially used by the landowner, other farm tenants, contractors, and third parties whose activities, animals, equipment, structures, and property may be present in areas the Student accesses. The Farm does not own, control, or maintain all structures, equipment, animals, or materials present on the property. By enrolling my Student in the Farm School program, I accept the inherent risks of a working, multi-use agricultural environment, including risks arising from conditions, equipment, animals, or activities not directly under the Farm’s control. Nothing in this waiver releases any third party, including the landowner or other tenants, from their own independent legal obligations.

Animals

I understand that Farm School activities include direct, hands-on interaction with farm animals as a core component of the curriculum. Animals the Student may handle, feed, observe, or work near include but are not limited to: alpacas, goats, sheep, pigs, horses, cows, rabbits, chickens, ducks, and working livestock guardian dogs. Animals belonging to the landowner, other tenants, or third parties may also be present on the shared property. I understand that all animals may behave unpredictably regardless of temperament or prior handling. Specific risks include but are not limited to: bites, kicks, strikes, scratches, and headbutts; being knocked down, pinned, trampled, or crushed; injury from horns, hooves, tusks, or claws; injury from animal-to-animal conflict in the Student’s presence; zoonotic illness or infection transmissible from animals to humans; and allergic reactions to animals, dander, hair, saliva, or droppings. I acknowledge that no amount of supervision or precaution can fully eliminate these risks and I accept them as inherent to the program.

Tools, Equipment, and Hands-On Activities

I understand that Farm School activities are hands-on and include supervised use of age-appropriate farm tools and equipment. Tools and activities may include but are not limited to: hand tools such as rakes, shovels, hoes, pitchforks, and trowels; child-appropriate cutting tools used under direct staff supervision; buckets, feeders, watering equipment, and farm materials; gardening and planting activities; food preparation using age-appropriate utensils under staff supervision; and other hands-on farm tasks suitable to the Student’s age and developmental level. Adult knives and butchering equipment are not part of the Farm School curriculum and will not be used by students. All tools and equipment used in the Farm School program are selected and supervised with the Student’s age and developmental level in mind. I acknowledge that even age-appropriate tool use carries inherent risk of minor injury and I accept that risk as part of an experiential agricultural education program.

Food Preparation and Consumption

I understand that Farm School activities may include food preparation and eating as part of the educational curriculum. I confirm that I have disclosed all known food allergies and dietary restrictions for my Student on the enrollment form. I understand that while the Farm will make reasonable efforts to accommodate disclosed allergies, it cannot guarantee an allergen-free environment. I accept full responsibility for any reaction or illness arising from food consumed during Farm School activities and release the Farm from all related claims except in cases of gross negligence.

Environmental and Property Conditions

I understand that Farm School takes place in an active outdoor agricultural environment that includes inherent and variable hazards such as uneven terrain, mud, standing water, slippery surfaces, low overhead clearance, and unpredictable weather. I accept these as inherent conditions of the program and acknowledge that outdoor farm work involves physical activity and exposure to the elements that cannot be fully controlled.

Personal Property

The Farm is not responsible for loss, theft, or damage to any personal property brought onto the premises, including but not limited to clothing, footwear, electronics, backpacks, and personal effects. I understand that farm activities are physical and take place outdoors, and I agree to dress my Student appropriately in clothing and footwear that can get dirty, wet, or damaged.

Communicable Illness

I understand that participation in Farm School involves in-person contact with other students, staff, and animals in an outdoor agricultural environment. The Farm cannot guarantee a communicable-disease-free environment. I voluntarily assume the inherent risk of exposure to communicable illness on behalf of my Student and agree not to send my Student to Farm School if they are exhibiting symptoms of illness.

Assumption of Risk

On behalf of myself, my Student, and our respective heirs, assigns, and next of kin, I assume all risk and take full personal responsibility for any injury, illness, death, or property damage arising from my Student’s participation in the Farm School program or presence on the shared premises. This includes but is not limited to: all animal-related risks described above; supervised use of age-appropriate tools and equipment; food preparation and consumption activities; exposure to the outdoor farm environment and its variable conditions; drop-off sessions during which the Student participates under Farm staff supervision without a parent or guardian present; and any other activities associated with the Farm School curriculum or the shared property environment.

Drop-Off Sessions and Supervision Authorization

By signing this waiver, I authorize my Student to participate in drop-off Farm School sessions under the supervision of Farm staff without a parent or guardian present. I confirm that I am comfortable with my Student engaging in all Farm School activities described in this document — including animal handling, age-appropriate tool use, food preparation, and outdoor farm work — under staff supervision. I understand that in the event of an emergency during a drop-off session, Farm staff will attempt to contact me or my designated emergency contact immediately and will call 911 if warranted. I agree to adhere to published drop-off and pick-up times and to communicate any changes promptly.

Authorized Accompanying Adults and Alternate Pickup

Any adult other than myself who accompanies my Student during a Farm School session, or who is authorized to drop off or pick up my Student, is named on the enrollment form. I confirm that any such adult has been informed of and agrees to observe all Farm rules, safety guidelines, and staff instructions while on the premises. By authorizing another adult to accompany my Student, I accept that such adult will exercise supervisory responsibility for my Student during that session. I further waive and release the Farm from all claims arising from injury to or death of my Student while in the care of an authorized accompanying adult, to the same extent as if I were present. The Farm will not release my Student to any individual not listed on the enrollment form without my prior written or verbal authorization.

Student Conduct and Program Expectations

I agree to prepare my Student to participate respectfully and safely in Farm School activities. I understand that students are expected to follow all staff instructions, treat animals and fellow students with care, and observe all Farm safety guidelines at all times. The Farm reserves the right to remove a student from the program without refund if their behavior poses a safety risk to themselves, other students, animals, or staff.

Photography and Media

Photography and media consent for Farm School students is governed by a separate Media Release form. Please ensure your signed Media Release is on file at enrollment.

Entire Agreement

This WAIVER AND RELEASE constitutes the entire agreement between the parties regarding the Student’s participation in the Farm School program and supersedes any prior written or oral agreements. Its provisions may be amended only upon prior written consent of all parties. This agreement remains in full force and effect for the duration of the enrolled program and thereafter with respect to any claims arising from the Student’s participation.

Voluntary Execution

By checking the acknowledgment box and signing the Feral Woman Farm LLC Farm School Enrollment Form, I confirm that I have read, understand, and fully agree to the terms of this WAIVER AND RELEASE. I understand that I am giving up considerable future legal rights on behalf of myself and my Student. I agree freely and voluntarily, without duress, inducement, or promise. I am 18 years of age or older, am the legal parent or guardian of the enrolled Student, and am mentally competent to enter into this agreement. My signature on the Enrollment Form constitutes my binding acceptance of all terms herein to the same extent as a direct signature on this document.

By checking the acknowledgment box and signing the Enrollment Form, I am making a promise not to sue Lulu Redder, Feral Woman Farm LLC, Feisty Fowl LLC, or their agents or employees.
